1. Terms of Service

1.1 Acceptance

By installing or using the BlinkSum Chrome extension, website, or API ("Service"), you agree to these Terms, the Privacy Policy, and the Refund Policy (collectively "Agreement"). If you do not agree, do not use the Service.

1.2 Eligibility & Accounts

You must be at least 18 years old (or have parental consent if 13-17) and legally able to form a contract. Sign-in uses Google OAuth; you are responsible for your credentials and all activity on your account.

1.3 Our Service

BlinkSum generates AI-powered summaries of public YouTube videos and enables follow-up conversations. Each summary or question consumes one "credit."

Credits reset monthly on your subscription anniversary date.

The Service is provided "as is" without warranties of any kind. AI-generated summaries may contain errors or inaccuracies. To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid us in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

1.8 Indemnification

You agree to indemnify, defend, and hold harmless SmartSurf Online, its officers, employees, and agents against any third-party claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of this Agreement.

1.9 Suspension & Termination

We may suspend or terminate accounts for breach of these Terms or legal reasons. Upon termination, unused credits are forfeited except as described in the Refund Policy.

1.10 Governing Law

This Agreement is governed by the laws of Delaware (USA). Disputes will be resolved in Delaware courts unless we elect binding arbitration or small-claims court.

1.11 Changes to this Agreement

We may update these Terms by posting a revised version and changing the "Last updated" date above. Material changes will be announced in the extension or by email. Continued use after changes take effect means you accept the revised Terms.

1.12 Miscellaneous

If any provision is held unenforceable, the remainder remains in effect (Severability). Failure to enforce a provision is not a waiver (No Waiver). This Agreement constitutes the entire agreement regarding the Service (Entire Agreement).
