VidSum AI – Terms of Service, Privacy Policy & Refund Policy

1. Terms of Service (“TOS”)
1.1 Acceptance
By installing or using the VidSum AI Chrome extension, website or API (“Service”), you agree to these Terms, the Privacy Policy and the Refund Policy (collectively “Agreement”). If you do not agree, do not use the Service.
1.2 Eligibility & Accounts
You must be at least 18 years old (or have parental consent if 13-17) and legally able to form a contract. Sign-in uses Google OAuth; you are responsible for your credentials and all activity on your account.
1.3 Our Service
VidSum AI generates AI-powered timestamps and summaries of public YouTube videos and answers follow-up questions. Each summary or question consumes one “credit.” New users receive 10 free credits; additional one-time credit packs (e.g. 300 credits = US $5) are available (no subscriptions).
1.4 Credits & Payments
- Transactions are processed by an authorised merchant of record(MoR); the MoR appears on your receipt.
- Prices exclude applicable taxes, which the MoR calculates & remits.
- Credits never expire while your account is active.
1.5 Intellectual Property & DMCA
We own the software and branding. You own your prompts and may use the generated summaries in compliance with YouTube’s TOS and copyright law. DMCA notices: email us.
1.6 Acceptable Use
You agree not to violate any law, reverse-engineer, overload, scrape or misuse the Service, nor use outputs to build competing models.
1.7 Disclaimers & Limitation of Liability
The Service is provided “as is.” To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid us in the preceding 12 months. We are not liable for indirect or consequential damages.
1.8 Indemnification
You agree to indemnify, defend and hold harmless SmartSurf Online, its officers, employees, agents and the Merchant-of-Record against any third-party claims, losses or expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of this Agreement.
1.9 Suspension & Termination
We may suspend or terminate accounts for breach or legal reasons. Upon termination, unused credits are forfeited except as described in the Refund Policy.
1.10 Governing Law
This Agreement is governed by the laws of Delaware (USA). Disputes will be resolved in Delaware courts unless we elect binding arbitration or small-claims court.
1.11 Changes to this Agreement
We may update these Terms at any time by posting a revised version and changing the “Last updated” date above. Material changes will be announced in-app or by email. If you continue to use the Service after changes take effect, you accept the revised Terms.
1.12 Export Compliance
You may not use, export or re-export the Service (a) into, or to a resident of, any country subject to U.S., UK or EU embargo; or (b) to anyone on OFAC’s Specially Designated Nationals list or other sanctions lists.
1.13 Miscellaneous
If any provision of this Agreement is held unenforceable, the remainder remains in effect (Severability). Failure to enforce a provision is not a waiver (No Waiver). This Agreement constitutes the entire agreement between us regarding the Service (Entire Agreement).
2. Privacy Policy
2.1 Data We Collect
- Account data: Google UID, name, email
- Usage data: video URLs, prompts, credit usage, IP/browser metadata
- Payment data: order ID, pack type (card details are stored only by the MoR)
- Cookies/local storage: session token, preferences
2.2 How We Use Data
Operate & improve the Service, provide support, send essential notices, process payments, prevent fraud, and comply with law. We may use aggregated or de-identified data for analytics.
2.3 Sharing & Third Parties
We never sell personal data. We share it only with hosting/LLM providers, the MoR, or when required by law.
2.4 Cookies
Essential cookies keep you logged in; optional analytics cookies (Plausible, cookie-free) help measure usage. You can disable cookies but some features may break.
2.5 Retention & Security
We retain data as long as needed for the purposes above and protect it with encryption in transit & at rest plus least-privilege access.
2.6 Your Rights
Depending on your jurisdiction you may access, correct, delete or export your data. Requests: smartsurf.online@gmail.com. California residents may exercise CCPA rights through the same email.
2.7 Data-Processing Addendum (DPA)
If you require a signed DPA under GDPR/UK GDPR, email us at the address above. We provide a standard addendum covering controller-processor obligations, EU Standard Contractual Clauses and UK Addendum on request.
3. Refund Policy
3.1 14-day “unused-credit” guarantee
You may request a full refund within 14 days of purchase if no purchased credits have been used.
3.2 Used or partial credit packs
Once any credits from the pack are consumed, the sale is final and non-refundable.
3.3 Request procedure
Email your order ID to smartsurf.online@gmail.com. Valid requests are processed via the MoR to the original payment method within 5-7 business days.
